1. Acceptance of Terms

By downloading, installing, accessing, or using Builds TV - IPTV Player (“the App”), you agree to be bound by these Terms & Conditions (“Terms”). These Terms constitute a legally binding agreement between you and Builds by YD (“we”, “us”, “our”, or the “Developer”). If you do not agree to these Terms, you must uninstall and cease use of the App immediately.

2. "Bring Your Own Playlist" (BYOP) & Content Disclaimer

Builds TV is strictly an empty media player. The Developer does not sell, host, provide, or distribute any media content, audio, video, live streams, or M3U playlists.

• User Responsibility: You, the user, are solely responsible for providing your own content. By adding an M3U playlist URL to the App, you verify that you have the legal right and necessary permissions to access and view the media contained within that playlist.
• No Endorsement: The Developer does not endorse, verify, or have any control over the external servers or content you choose to stream through the App.
• Copyright Compliance: We strictly condemn copyright infringement. However, because the App operates entirely locally and we do not host or monitor user-provided URLs, we cannot actively police the streams you choose to play. We bear zero liability for copyright violations committed by users accessing unauthorized streams.

3. Intellectual Property

All original user interface designs, logos, graphics, and proprietary code contained within the App are the exclusive property of the Developer. You are granted a limited, personal, non-transferable license to use the App for non-commercial media playback.

4. Hardware Performance & Stream Stability

The App relies on your television's hardware to decode media and your personal Internet connection to fetch data. We do not guarantee uninterrupted playback, as buffering, audio-sync issues, and stream failures are typically caused by the user's network or the third-party server hosting the user's playlist.

5. Disclaimer of Warranties

BUILDS TV IS PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS WITHOUT WARRANTIES OF ANY KIND, EITHER EXPRESS OR IMPLIED. WE DO NOT WARRANT THAT THE SOFTWARE WILL BE COMPLETELY UNINTERRUPTED, ERROR-FREE, OR COMPATIBLE WITH EVERY COMBINATION OF TIZEN OS VERSIONS AND MEDIA CODECS.

6. Limitation of Liability & Indemnification

• Exclusion of Damages: TO THE MAXIMUM EXTENT PERMITTED UNDER APPLICABLE LAW, IN NO EVENT SHALL THE DEVELOPER BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES RESULTING FROM THE USE OR INABILITY TO USE THE APP.
• Indemnification: You agree to fully defend, indemnify, and hold harmless the Developer from any legal claims, liabilities, or damages brought forward due to your misuse of the App or your streaming of unauthorized copyrighted material.

7. Dispute Resolution & Governing Law

These Terms shall be governed and interpreted in strict accordance with the laws of the Commonwealth of Virginia, United States. Any disputes arising under these Terms shall be resolved exclusively through final and binding individual arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules in the Commonwealth of Virginia. YOU EXPLICITLY WAIVE ANY RIGHT TO PARTICIPATE IN ANY CLASS-ACTION LAWSUIT.
